• Defined pricing and timelines

Any additional features or modifications outside the agreed scope may result in additional charges.

4. Payments & Billing

• All prices are quoted in Pakistani Rupees (PKR) unless stated otherwise.

• Advance payments may be required before project initiation.

• Remaining payments must be cleared according to the agreed schedule.

• Delayed payments may result in suspension of services.

Bank charges, gateway fees, or third-party service costs are the responsibility of the client unless otherwise agreed.

5. Payment Gateway Services

Orbitcom acts as a technology integration provider, not a bank or financial institution.

• Final approval of payment gateway activation depends on the respective bank or financial service provider.

• Orbitcom is not responsible for rejection, compliance delays, or regulatory decisions made by banks or third parties.

• Clients must comply with applicable financial and regulatory laws in Pakistan.

6. Intellectual Property

• All content, designs, code, software, and materials developed by Orbitcom remain the intellectual property of the Company until full payment is received.

• Upon full payment, ownership of custom-developed work may be transferred as agreed.

• Unauthorized copying, resale, or redistribution is strictly prohibited.

7. Confidentiality

Both parties agree to maintain confidentiality regarding:

• Business information

• Financial details

• Technical data

• Login credentials and proprietary documentation

Confidential information shall not be disclosed unless required by law.

8. Third-Party Services

Orbitcom may integrate or rely on third-party services including:

• Banks and payment gateways

• Hosting providers

• API platforms

• Software tools

We are not responsible for downtime, data loss, or service interruptions caused by third-party providers.

9. Limitation of Liability

Orbitcom (SMC-Private) Limited shall not be liable for:

• Indirect or consequential losses

• Loss of profits, revenue, or data

• Delays caused by force majeure events

• Decisions made by financial institutions or regulators

Maximum liability, if any, shall not exceed the total amount paid for the specific service.

10. Termination

Orbitcom reserves the right to suspend or terminate services if:

• These Terms are violated

• Fraudulent or illegal activity is detected

• Payments remain outstanding

Termination due to client misconduct does not entitle the client to a refund.

11. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the Islamic Republic of Pakistan.
Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Pakistan.

12. Changes to Terms

Orbitcom reserves the right to modify or update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.
